Terms of Service

Last updated: 26 October 2026

1. Provider and scope

These terms apply to the Brandlyft service provided by Kjell Kuttler, Brandlyft, Richard-Zanders-Straße 53, 51469 Bergisch Gladbach, Germany (“Brandlyft”). The service is intended for businesses only, not for consumers.

2. The service

Brandlyft analyses the website of a business, creates social media content (texts, images, videos) with the help of AI models and, depending on the settings chosen by the customer, publishes it on connected accounts on Instagram, Facebook and TikTok and reports its performance. The scope of each package is described on the pricing page or in the individual offer.

3. Account and connected platforms

The customer connects social media accounts through the official login of each platform and may disconnect them at any time. The customer must own or be authorised to manage the connected accounts and must comply with the terms of the respective platforms.

4. Responsibility for content

The customer can choose between approving each post and autopilot. The customer remains responsible for the content published on its accounts, in particular for the accuracy of product information, compliance with advertising law and the labelling of AI-generated content. Brandlyft creates content based on the information provided by the customer and its website and does not knowingly invent reviews, statistics or claims.

5. Rights to content

The customer grants Brandlyft the rights to its brand assets and product information that are needed to provide the service. Content created for the customer may be used by the customer without restriction. Brandlyft may use anonymised performance data to improve the service.

6. Prices and payment

Prices are stated per month and are payable in advance. Subscriptions can be cancelled at the end of each billing period.

7. Availability

Brandlyft depends on third-party platforms and AI providers. We aim for high availability but cannot guarantee that every post is published at the planned time, for example if a platform changes or restricts its interfaces.

8. Liability

Brandlyft is liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence, Brandlyft is only liable for breaches of essential contractual obligations and limited to the typical, foreseeable damage. Liability under the German Product Liability Act remains unaffected.

9. Data protection

Personal data is processed in accordance with our Privacy Policy. Where Brandlyft processes personal data on behalf of the customer, a data processing agreement applies.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Bergisch Gladbach, insofar as the customer is a merchant.
